Can 'last in first out' (LIFO) be used as a redundancy selection criteria?

There is certainly merit in potentially retaining your more experienced staff. However, using LIFO as a single criteria is likely to be regarded as an unfair selection process as those with longer service and therefore more experience are usually older than those with shorter service and less experience. If using LIFO, it should always be used with other meaningful selection criteria. For further information regarding redundancies, read our May2010 newsletter for more information.

From 1 February 2010

  • Minimum amount of compensation where individual excluded or expelled from union in contravention of section 174 of the 1992 Act and not admitted or re-admitted by date of tribunal application; down from £7,300 to £7,200.
  • Limit on amount of guarantee payment payable to an employee in respect of any day; down from £21.50 to £21.20
  • Limit on amount of compensatory award for unfair dismissal, down from £66,200 to £65,300
