I’ve heard that when staff are paid monthly, their notice period should be monthly too?
This is a regular assumption and sadly, untrue. Regardless of how an employee is paid, the statutory notice period provides for no notice within the first month of employment, and a week for every full year worked thereafter up to a maximum 12 weeks notice. This is the minimum that can be given. However, the employer may wish to increase the notice period; any increase to the length of notice should be agreed with the employee and clearly written within the statement of terms and conditions (usually referred to as the Contract of Employment).
From 1 February 2010
- Minimum amount of compensation where individual excluded or expelled from union in contravention of section 174 of the 1992 Act and not admitted or re-admitted by date of tribunal application; down from £7,300 to £7,200.
- Limit on amount of guarantee payment payable to an employee in respect of any day; down from £21.50 to £21.20
- Limit on amount of compensatory award for unfair dismissal, down from £66,200 to £65,300
